STORE POLICIES
Last updated: November 4, 2026
Please read these terms carefully before ordering. They explain how purchases from BioActive Peptides work, the restrictions on how our products may be used, and the limits of our responsibility. By creating an account, placing an order, or buying any product from us, you confirm that you have read these terms and agree to follow them.
Part I — Terms of Sale
1. About These Terms
These Terms & Conditions (the “Terms”) apply to every product and service offered by BioActive Peptides LLC (“BioActive,” “we,” “us,” or “our”) through bioactivepeps.com (the “Site”). “You” and “Buyer” mean the person or organization placing an order. If you do not agree to these Terms, do not order from the Site. We may update these Terms at any time by posting a new version here; the new version applies from its “Last updated” date, and ordering after that date means you accept it.
2. Key Terms
- “Products” means anything you buy from us, including peptides, reagents, powders, liquids and laboratory supplies.
- “Research Use” means genuine in-vitro laboratory, analytical or development work carried out by trained personnel. It does not include clinical, diagnostic or human-subject research, or any use in or on a human or animal.
- “Qualified Researcher” means a person aged 21 or older with the training, equipment and facilities to handle, store and use the Products safely and lawfully for Research Use.
3. For Research Use Only
All Products are sold strictly for laboratory research use. They are not for human or animal consumption of any kind, and they are not drugs, foods, dietary supplements, medical devices or cosmetics. Statements on the Site have not been evaluated by the U.S. Food and Drug Administration, and the Products are not intended to diagnose, treat, cure or prevent any disease.
You may not use any Product: (a) in or on a human or animal; (b) as, or as part of, a food, drug, supplement, medical device or cosmetic; (c) for in-vitro diagnostic purposes; or (d) for any commercial purpose. You agree that the Products will be handled only by Qualified Researchers.
4. Our Regulatory Status
BioActive Peptides is a supplier of research chemicals. We are not a compounding pharmacy under Section 503A of the Federal Food, Drug, and Cosmetic Act (“FDCA”), and we are not an outsourcing facility under Section 503B. We do not compound or dispense drugs, do not fill prescriptions, and do not market or sell Products for the diagnosis, treatment, mitigation, cure or prevention of any disease.
5. Who May Buy
You must be at least 21 years old to order. By placing an order you confirm that you are 21 or older, that you are a Qualified Researcher or are buying on behalf of one, and, if you are ordering for an organization, that you are authorized to bind it to these Terms. At checkout you will be asked to confirm that the Products are for research use only. We may ask for proof of age, qualifications or institutional affiliation, and we may refuse, limit or cancel any order or account if we believe these requirements are not met or that information provided is false or incomplete.
6. Permitted Use
When you buy a Product, we give you a limited, non-exclusive, non-transferable right to use the quantity purchased for your own internal Research Use. No right to resell the Product, or any part of it, is granted. The Products may not be used in any commercial application, including commercial testing services or reporting research results for a fee.
7. Restrictions
You will not, directly or indirectly: (a) use any Product for anything other than Research Use; (b) resell, repackage, relabel, or use a Product as an ingredient or component of another product; (c) export or re-export any Product; or (d) give or transfer any Product to a third party without first obtaining our written approval. We may limit order quantities, or decline to sell to any customer, at our discretion.
8. Your Promises to Us
You confirm that, based on your own review, you understand the health and safety hazards of handling the Products, the controls needed to protect anyone who handles them, the need to warn others of those hazards, and the laws and regulations that apply to their use. You agree to handle, test and use the Products as a reasonable expert in the field would, in full compliance with all applicable federal, state and local laws.
9. Regulatory Compliance
You are responsible for ensuring that anything you produce using our Products is not adulterated or misbranded under the FDCA and complies with all applicable law. Because the Products are intended for research, they may not appear on the Toxic Substances Control Act (“TSCA”) inventory; you are responsible for any TSCA requirements that apply to your use. You are also solely responsible for compliance with export-control laws.
10. Hazards and Duty to Warn
Handling research chemicals carries risk. You are responsible for identifying the hazards of each Product, researching them further as needed, and warning anyone else who may handle the Product, including your staff and shipping personnel. You agree to follow any handling instructions we provide and not to misuse any Product.
11. No Warranties
PRODUCTS ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.” WE HAVE NOT TESTED ANY PRODUCT FOR SAFETY OR EFFECTIVENESS IN ANY FOOD, DRUG, MEDICAL, COSMETIC, COMMERCIAL OR OTHER USE. TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Certificates of Analysis describe the results of testing on a specific lot and are provided for information only. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
12. Limitation of Liability
TO THE FULLEST EXTENT ALLOWED BY LAW, NEITHER BIOACTIVE PEPTIDES NOR ITS OWNERS, OFFICERS, EMPLOYEES OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE, ARISING FROM THESE TERMS OR ANY PRODUCT, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to defend, indemnify and hold harmless BioActive Peptides and its owners, officers, employees and agents from any claims, losses, damages, penalties, costs and expenses (including reasonable attorneys’ fees) arising from: (a) your handling, storage, testing, use or disposal of any Product; (b) your breach of these Terms; (c) your violation of any law or regulation; (d) any regulatory action connected to your activities; or (e) your transfer of any Product to a third party.
14. Intellectual Property
We do not warrant that using or selling any Product will not infringe a patent or other right of a third party, and listing a Product on the Site is not a license or recommendation to use it in a way that infringes. Apart from the limited right of use in Section 6, no license to any of our intellectual property is granted. You own the research data you generate through permitted use of the Products.
15. Governing Law and Disputes
These Terms, and any dispute relating to them or to any Product, are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules. Any legal action must be brought in the state or federal courts located in Fairfield County, Connecticut, and both parties consent to the jurisdiction of those courts. The prevailing party in any such action may recover its reasonable attorneys’ fees and costs to the extent allowed by law. Nothing in these Terms restricts your right to post an honest review of us or our Products.
16. General
Entire agreement. These Terms, your order confirmation and our Privacy Policy are the entire agreement between you and us about your purchase. No waiver. If we do not enforce a provision, that is not a waiver of it. Severability. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect. Assignment. You may not transfer these Terms without our written consent. Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, carrier delays, supply shortages or government action. Notices. Notices to us must be sent to support@bioactivepeps.com or to 1010 Summer Street, Stamford, CT 06905. We may send notices to the email or address on your account or order.
Part II — Website and Store Policies
17. Site Content
All content on the Site, including text, design, logos, graphics and images, belongs to BioActive Peptides LLC and is protected by copyright and trademark law. You may use the Site only to browse and place orders. You may not copy, reproduce, republish or distribute any content from the Site without our written permission.
18. Order Acceptance
Placing an order is an offer to buy. An order confirmation email confirms only that we received your order; it is not our acceptance. We may accept, decline, or partially fill any order for any reason.
19. Pricing and Errors
Prices may change without notice. You pay the price shown on the Site when your order is placed. Volume pricing (5% off 5–9 units and 10% off 10 or more units of the same product) is applied automatically in the cart. If a Product is listed at an incorrect price because of a typographical or system error, we may cancel any order for that Product, even after confirmation or payment, and will refund any amount charged.
20. Payment
We accept the payment methods shown at checkout. Please enter your billing details exactly as your card issuer or bank has them on file; incorrect details may delay your order. You confirm that the payment information you provide is accurate and that you are authorized to use the payment method.
21. Shipping
We ship to addresses in the United States only. Orders typically ship within 1–2 business days of payment, excluding weekends and holidays, and you will receive a tracking number by email once your order ships. Shipping options and costs are shown at checkout; orders of $200 or more qualify for free 2-day express shipping. Delivery times are estimates provided by the carrier and are not guaranteed. Title and risk of loss pass to you when we hand your order to the carrier.
22. Cancellations
You may cancel an order before it ships by contacting support@bioactivepeps.com with your order number. Once an order has shipped, it cannot be canceled.
23. All Sales Final; Damaged, Wrong or Missing Items
All sales are final. Because of the nature of research materials, we do not accept returns or exchanges once an order has shipped.
Damaged in transit: if your order arrives damaged, email support@bioactivepeps.com within 48 hours of delivery with your order number and clear photos of the damaged item(s) and the shipping box. Once we confirm the damage, we will send a replacement for the damaged item at no charge, or refund that item if it is out of stock.
Wrong or missing items: if you receive the wrong item, or an item is missing from your order, contact us within 48 hours of delivery and we will make it right.
Claims submitted after 48 hours, or without the required photos, cannot be accepted.
24. Taxes
We collect sales tax where we are required to do so. You are responsible for any other taxes that apply to your purchase.
25. Privacy
We collect and use personal information, such as your name, contact details, shipping address and order history, to process and deliver your orders and to communicate with you. How we collect, use, share and protect that information is described in our Privacy Policy, which is part of these Terms.
26. Third-Party Links and Services
The Site may link to websites we do not control, and our store runs on third-party software and services, including WooCommerce. We are not responsible for the content or practices of those third parties.
27. Other Conditions
These Terms override any terms you include with a purchase order. If Part I and Part II conflict, Part I controls as to the sale and use of the Products.
